What will this dismissal cost you?

What to know

What does an unfair dismissal cost?

It depends on the country: one month of pay per year of service between 3 and 20 months in Côte d'Ivoire, 3 to 24 months in Togo, 3 to 9 months in Benin, a month and a half per year up to 36 months in Morocco, no cap in Senegal, Mali and Ghana.

How is the notice period set?

By the collective agreement or a decree, by the employee's category and seniority. Notice the employer does not want worked is paid.

What if the procedure is not followed?

An indemnity is added: up to 3 months of pay in Togo and Senegal, 2 months in Benin, 1 month in Mali. A rushed procedure also makes the dismissal easier to have held unfair.

Who are protected employees?

Staff delegates, whose dismissal needs the labour inspector's authorization, and pregnant employees or those on maternity leave. Dismissing them without following these rules makes the dismissal void or very costly.
