New Labour Code · Senegal 2026
Are your fixed-term contracts already permanent?
What to know
When does a fixed-term contract become permanent?
In Senegal, a contract that is not written, fills a permanent job, runs over two years, is renewed more than once or exceeds four years in all with the same employee becomes permanent, except for the reasons in article 101 (replacement, peak in activity, seasonal, occasional).
Must the contract be filed with the labour inspectorate?
Yes in Senegal under the new Code: the contract is filed before work starts, and so is each renewal and each extension (articles 99, 102 and 103).
Does the new Code apply to contracts already signed?
Yes: it applies to contracts in progress, without being on its own a reason to end them (article 459). The text does not say whether months already worked count towards the four-year cap: the safe course is to count them.
And in the other countries?
The tool applies each country's maximum lengths: two years in all in Côte d'Ivoire and Mali, two years then four in all in Togo, six months for a temporary worker in Ghana, one year renewable once in Morocco in the cases the code sets.
